TONL Terms of Use

Welcome to TONL! These Terms of Use (“Terms”) govern your access to and use of TONL’s platform, including our stock photography services, TONL AI (our generative AI image tool), and any other services we provide (collectively, the “Services”). By using TONL, you agree to these Terms. Please read them carefully. If you do not agree, you should not use TONL.

1. Our Mission and Service Overview

TONL’s mission is to transform the idea of stock photography by showcasing the beauty of diverse cultures and redefining how people of color are portrayed in the media. With TONL AI, we extend this mission by offering an AI-powered image generator trained exclusively on TONL’s culturally authentic and inclusive photo library. This ensures that generated visuals are representative, diverse, and rooted in lived realities—not biased or generic datasets.

Our Services include:

Stock Photography: Access to TONL’s curated image collections. TONL AI: A generative AI tool that allows users to create culturally inclusive images. Community & Content Features: Educational resources, storytelling, and other creative tools.

TONL AI is in beta. We are continually refining its features and outputs to best serve our community.

2. Account Registration and Eligibility

Some Services, including TONL AI, require an account.

Account Information: You must provide accurate, up-to-date details (such as email and password).

Age Requirements: You must be at least 18, or the age of majority in your jurisdiction, to create an account. Users 13–17 may only use TONL AI with parent/guardian supervision. Children under 13 are not permitted.

Responsibility: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. Acceptable Use Policy

By using TONL, you agree not to:

  • Violate laws, regulations, or intellectual property rights.
  • Generate, upload, or share content that is harmful, harassing, discriminatory, sexually explicit, or promotes violence.
  • Misuse TONL AI to create misleading, defamatory, or harmful representations of individuals or groups.
  • Attempt to reverse engineer or extract TONL’s models, datasets, or source code.
  • Manipulate, misrepresent, or distort TONL AI outputs or screenshots in ways that could discredit or misrepresent TONL, its models, or outputs.
  • Use automated systems (bots, scrapers) to excessively query or burden our Services.

Violation of these rules may result in account suspension or termination.

4. Generative AI Output – Important Disclaimers

Accuracy: While TONL AI is trained on curated, authentic datasets, generated outputs may still contain errors, inaccuracies, or unexpected elements.

No Professional Advice: Outputs are for creative and informational use only. They should not be treated as legal, medical, financial, or other professional advice.

Bias & Limitations: We work to reduce bias in AI outputs, but no system is bias-free. Users should apply critical judgment.

Experimental Nature: TONL AI is in beta. By using it, you acknowledge it may produce variable results and occasional errors.

5. Intellectual Property and Data Ownership

Your Inputs & Outputs: You retain ownership of the prompts you enter. TONL grants you a broad license to use the AI-generated images you create, subject to these Terms.

Restrictions: You may not claim TONL AI-generated outputs as entirely human-created. You may not use outputs in defamatory, discriminatory, or exploitative contexts.

TONL’s Rights: All software, datasets, and infrastructure (including the TONL image library) remain TONL’s intellectual property. The TONL name, logo, and branding are protected trademarks.

6. Privacy and Data Use

Your use of TONL is also governed by our Privacy Policy. Key points:

  • We do not sell or share your personal data with third parties for marketing.
  • We may store prompts and outputs to improve TONL AI, subject to strict confidentiality.
  • You can request deletion of your account or data by contacting hello@TONL.co.

7. Limitation of Liability and No Warranty

TONL provides the Services “as is,” without warranties of accuracy, fitness for a purpose, or non-infringement.

TONL is not liable for any direct, indirect, incidental, or consequential damages resulting from use of the Services or reliance on outputs.

You are solely responsible for verifying outputs before using them in sensitive or professional contexts.

8. Modifications and Termination

We may update these Terms or discontinue Services at any time. If we make material changes, we will notify registered users via email or by posting a notice on our website. Continued use after updates constitutes acceptance.

You may delete your account at any time. TONL may suspend or terminate accounts that violate these Terms.

9. Indemnificationn

You agree to indemnify and hold TONL harmless from claims, damages, or expenses (including legal fees) arising from your misuse of the Services, violation of these Terms, or infringement on others’ rights.

10. Governing Law

These Terms are governed by the laws of the United States and specifically the laws of the State of Washington, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Seattle, WA, USA.

11. Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Failure to enforce a right is not a waiver of that right.
